Lindsay Lohan’s house arrest to end next week

Actress Lindsay Lohan’s house arrest for stealing a necklace from a Venice jewelry store is scheduled to end Wednesday.

Angry with paparazzi photos apparently showing Lohan partying on the rooftop of her Venice home, Los Angeles County Superior Court Judge Stephanie Sautner told the actress Thursday she could not entertain more than one guest at a time while under house arrest.

But that restriction will end Wednesday when Lohan completes a 35-day home-detention stint following her conviction for shoplifting a gold-and-diamond necklace.

The conviction came as Lohan was on probation in a driving-under-the-influence case.

Sautner sentenced the “Mean Girls” star in May to 120 days in jail, but Lohan applied for a low-risk offender diversion program created to ease jail overcrowding.
Lohan was deemed eligible and is serving the stint inside her beachfront home while wearing an electronic monitoring device.

Lohan was in court Thursday after a probation report said she failed a June 13 alcohol test, but Sautner ruled it did not violate her probation because the testing requirement had ended months earlier.

Legal experts said Lohan’s second positive test for alcohol since treatment last year at the Betty Ford Center in Rancho Mirage will make it harder for producers to insure her for film work.

“Most production companies are going to have trouble getting insurance for her. She is unpredictable; her insurance rates are very high,” said attorney Dmitry Gorin, who represents Hollywood clients.

Sautner appeared angry Thursday with Lohan’s recent behavior, saying the actress was guilty of “extremely poor judgment.”

Lohan’s neighbors had complained to Los Angeles County supervisors about the noise from her party, the judge said.

“If you are in jail, you are not allowed to have parties. House arrest should be akin to jail,” Sautner said. “I have no ground for modifying your probation. Don’t give me grounds. Do you want to get on with your life?”

“Yes, I do,” replied Lohan.

The judge snapped back: “[Then] don’t do stupid things that give people a reason to hate you. … Don’t do stupid things that fly in the face of the spirit of the court’s order. You knew I sentenced you to jail. You knew I was unhappy with house arrest.”

Lohan’s attorney, Shawn Holley, said Lohan did not do anything wrong because the alcohol test was not a condition of probation.

“Alcohol is a legal substance. She is permitted to drink alcohol,” Holley said outside court.

Holley would not confirm the actress drank alcohol but said Lohan did cancel a scheduled interview with NBC’s Matt Lauer recently because of concerns related to the alcohol-test investigation.

Just four days after Lohan’s detention began May 26, probation officials discovered her monitoring equipment had been damaged by friends spilling a drink on it.

Following the court appearance, Lohan took to Twitter.

“Thank you to all of my fans for your support. Sending you Love and Light,” Lohan wrote.

Lindsay Lohan: Kombucha tea made me fail alcohol test

Lindsay Lohan is adamant she did NOT drink wine, beer or liquor during her stint on house arrest … insisting her dirty test was caused by a fermented tea that contains a TEEEENY amount of alcohol.

Lohan has been telling friends she’s been drinking her favorite kombucha tea again … the same tea that caused her probation officer to raise a red flag earlier this year because it contains alcohol. The company behind the drink claims the alcohol content is less than .05%.

Of course, the judge ruled that Lindsay is ALLOWED to consume alcohol during her house arrest sentence … so the dirty test didn’t matter anyway.

TMZ spoke with Lindsay about the situation … and she told us, “I am responsible, and I’m following the rules and obeying my judge and the Los Angeles judicial system.”

She adds, ” I’d like to do what I must to get my film career back and the respect of directors, actors, writers, studio heads, fans and so on.”

Lindsay ‘calm and thankful’ after court finds no probation violation

After prospects of being put behind the bars, Lindsay Lohan can now take a sigh of relief as a new hearing has adjudged that she has not violated her probation rules at all.

A source close to Lohan said that she was actually very ‘calm and thankful’ ahead of the hearing, and was not afraid anymore of any impending imprisonment.

Judge Stephanie Sautner ruled that the prior judge on the case, Elden Fox, only required controlled substances testing from January 3 to February 25, 2011.

This certainly suggests that Lohan is free to drink all she wants without going over the limit.

“She’s done nothing wrong, she has done everything right,” the Fox News quoted Lohan’s attorney Shawn Chapman Holley telling a press conference proceeding the hearing.

“I think we need to give her some credit for that. She wasn’t supposed to be tested at all after February 25th. Alcohol is a legal substance,” she added.

Lindsay avoids jail, but judge bans parties during house arrest

Lindsay Lohan’s failed alcohol test last week will not be held against her because a judge did not renew a requirement that she be tested, according to a ruling in Los Angeles Thursday.

The requirements that her supervised probation include random alcohol and drug testing expired in February when she was arrested on a necklace theft charge and transferred from a Beverly Hills court to the Los Angeles airport branch, Judge Stephanie Saunter said.

“Lindsay has done nothing wrong,” defense attorney Shawn Holley said after the hearing.

Contrary to what the judge and the probation officer believed until Thursday, it was not against Lohan’s probation rules to drink and she did not have to submit to tests, Saunter ruled.

Lohan waited no time show she was happy with her court appearance. “Thank you to all of my fans for your support. Sending you Love and Light. xo,” she wrote in a Twitter posting an hour after leaving the courthouse.

The judge told Lohan she was guilty of “extremely poor judgment” by having roof parties while on home confinement, “but poor judgment is not a violation of your probation.”

Lohan failed an alcohol test administered by a probation officer last week and was ordered to go before the judge for a probation violation hearing Thursday morning. But Lohan’s attorney convinced the judge the testing requirement had lapsed in February.

The actress is confined to her Venice Beach, California, home because of a jail sentence imposed by Saunter last month. But Saunter failed to renew the testing requirement when she renewed Lohan’s supervised probation.

Lohan was allowed to serve a reduced sentence at home because, as a nonviolent offender, she qualified a home confinement program intended to reduce overcrowding.

“I am not happy about house arrest,” Saunter said Thursday. “It was not my sentence.”

The judge said she was on vacation when she saw media reports this month showing Lohan socializing on the roof of her luxury home in recent days.

“You are not to have parties,” Saunter said. “I am ordering it. You can have one friend at a time. That is it.”

The actress, who turns 25 on July 2, has managed to avoid more than a few days in jail despite two drunken-driving convictions, a long list of probation violations and the recent theft conviction.

Lindsay Lohan due in court for probation violation

Just weeks from completing her home detention sentence, troubled actress Lindsay Lohan is due in a Los Angeles court on Thursday (June 23) after allegedly violating her probation by testing positive for alcohol.

According to TMZ, the 24-year-old actress tested positive for alcohol earlier this month and could be facing additional jail time if the probation department has its way. The gossip site reported that Lohan was tested twice last week for drugs and alcohol and that unnamed sources said she tested positive for alcohol on one of the tests and negative on another; both were reportedly negative for drugs. One of the tests is reported to have taken place after a rooftop barbecue party Lohan had at her condo for friends on June 12.

In April, Lohan was sentenced to four months in jail for allegedly stealing a $2,500 necklace but was allowed to serve a reduced 35-day term at her Venice, California, condo. She was under strict home-confinement rules and wore an electronic monitoring device.

TMZ reported that the Los Angeles County Probation Department will ask the judge in the case to pull Lohan from house arrest and send her directly to Los Angeles County jail. Lohan’s attorney could not be reached for comment at press time.

Lohan was specifically told by the judge in her 2007 DUI case that she was not allowed to consume any alcohol while on probation.

As part of her plea deal in the necklace case, Lohan was also sentenced to perform 480 hours of community service, but was ordered not to perform that work until she completed her house arrest. She was also sentenced to undergo psychological counseling and participate in a shoplifters alternative course.

Michael Lohan blames himself for Lindsay’s addiction


Michael Lohan was a guest on The View yesterday to discuss his upcoming appearance on the new season of Celebrity Rehab With Dr. Drew. The man has always been outspoken about daughter Lindsay‘s substance abuse, but in this clip, he reveals to Sherri Shepherd and the other hosts that it was only after receiving Dr. Drew‘s treatment that he realized he was wrong to take their struggles public, and he takes responsibility for Lindsay’s addiction.

“At times I spoke out in the wrong ways and I did the wrong things and I led by the wrong example,” he says, and later confesses that “nine out of ten times” he would take back all of the things he has said publicly about Lindsay.
