Lohan sentenced to 120 days jail

Lindsay Lohan was back in jail on Friday after a rollercoaster day in which a judge downgraded her jewelry theft charge, but sentenced the actress to four months behind bars for violating her probation.

Looking confused and distressed, Lohan — who was locked up for two weeks last summer — was taken immediately to jail from court after a day-long preliminary hearing on charges that she stole a $2,500 gold necklace from a store in January.

The “Mean Girls” actress was ordered to stand trial on June 3 but the jewelry charge was reduced to a misdemeanor from a more serious felony, and will cut to one year her maximum time behind bars if eventually convicted.

Los Angeles judge Stephanie Sautner however felt the evidence on Friday suggested Lohan intended to steal the jewelry.

She therefore ruled Lohan had violated her probation for a 2007 drunk driving and cocaine possession incident, and sentenced her to 120 days jail and 480 hours community service in a morgue and womens’ prison.

Lohan’s lawyer filed an immediate appeal and Lohan’s camp scrambled to post $75,000 bail and secure her release from custody pending an appeal hearing.

Los Angeles County Sheriff’s Department spokesman Steve Whitmore told reporters Lohan would probably be released later on Friday once the paperwork was complete.

Lohan, 24, has strenuously denied that she deliberately walked out of a Los Angeles store wearing a necklace without paying. Her lawyer on Friday argued that she was distracted and absent-minded when she left with the item around her neck.

Lohan’s assistant returned it to police after news leaked that a search warrant was to be served on Lohan’s house.

“There is a lot of hoopla surrounding Ms. Lohan, but at the end of the day relatively speaking, this is not particularly serious as grand thefts go,” Lohan’s lawyer Shawn Holley said. ”This is a necklace…that was returned 10 days later.”

But judge Sautner did not buy the defense argument. “I see the intent here and I see the level of brazenness with ’let me see what I can get away with,’” Sautner said.

“She thumbs her nose at the court, she walks into court with FU on her fingernails,” Sautner said, referring to an appearance last year by Lohan in another case.

Lohan has been in and out of rehab, jail and courtrooms multiple times since 2007. Once considered among the most promising young actresses in Hollywood, Lohan’s movie career has come to a virtual halt.

Earlier this week she secured a role in an upcoming film about New York mobster John Gotti. But it was not clear how she would fit filming around possible prolonged spells locked up.

Lindsay Lohan out of Gotti movie

Lindsay Lohan’s gangster days appear to be over, on screen at least.

The actress is no longer in contention to play a real-life mob daughter in an independent movie about crime boss John Gotti, its producer said on Wednesday.

Lohan, whose promising career has been derailed by drug and criminal problems, was touted as a possibility to play Gotti’s daughter, Victoria. She even showed up at a news conference announcing the project last week.

But the producer of “Gotti: Three Generations” said talks have ended.

“We are not talking any further about Lindsay playing Victoria,” Marc Fiore was quoted as telling People magazine. “She is no longer being considered. The talks have stopped. We are going to meet with other people (for the role).”

It was unclear why Lohan, 24, was no longer being considered, although Hollywood gossip Web site TMZ suggested that the demands of Lohan’s management team got out of control.

TMZ quoted Fiore as saying, “I will only ride a merry-go-round with my kids.” An email seeking comment from Lohan’s manager was not immediately answered.

Fiore also needs to find a new director. Nick Cassavetes, who was reportedly opposed to any talks with Lohan, abruptly exited the project earlier this week because of what the producer called a scheduling conflict.

John Travolta will portray Gotti Sr, while “GoodFellas” veteran Joe Pesci has been cast as his close friend Angelo Ruggiero.

Lohan is scheduled to appear at a Los Angeles preliminary court hearing on Friday over a jewelry theft charge that will determine if she should stand trial. She could be sent to prison if eventually convicted.

Lindsay Lohan’s dad campaigns against drink driving

Lindsay Lohan’s father Michael has thrown his support behind a campaign to stamp out drink driving just months after his actress daughter was ordered to attend counselling in rehab in connection with a previous Dui conviction.

The Mean Girls star was convicted of drink driving in 2007 and has subsequently been in and out of prison and rehab, mostly recently completing a court-ordered three-month stay at California’s Betty Ford clinic in January.

Michael Lohan, who was himself convicted of driving under the influence in 2005, has now recorded a public service announcement as part of a campaign to stop people getting behind the wheel while intoxicated.

Is Lindsay Lohan getting special treatment in court?

Is it one rule for troubled actress Lindsay Lohan and another for all others?

That’s the question that has to be asked with the news that all cameras have been banned from the Mean Girls star’s court appearance this Friday.

It’s a stunning development because Judge Sautner, who Lindsay will be facing, allowed cameras in the courtroom for fellow actor, Mel Gibson’s plea on a misdemeanor battery charge just last month.

In addition, a well connected source tells RadarOnline: “It’s the DA’s policy that we will NEVER oppose having cameras in the courtroom, ever.

“The public has a right to see and know what is happening in the judicial system. There is a great deal of interest in the Lohan case, and it’s too bad that the public won’t have the opportunity to have access to the proceedings.”

Adding to the controversy further, all of Lindsay’s previous appearances in connection with the grand theft case – in front of Judge Keith Schwartz – had television cameras allowed in the courtroom.

The 24-year-old is due back in court for a preliminary hearing to ascertain if there is enough evidence to go to trial in her felony grand theft case.

Lohan is accused of stealing a $2,500 “one of a kind” designer necklace from a Venice Beach area jewelers.

Lindsay’s hearing is scheduled for April 22 and it’s anticipated that it could last 1-2 days.

As RadarOnline previously reported Lindsay’s preliminary hearing could be postponed though because it’s Good Friday, and all parties are agreeable to having the matter continued.

A final decision has yet to be made on whether or not to reschedule.

Lindsay Lohan: Good friday, good excuse!

Lindsay Lohan has a higher power on her side.

The troubled startlet of Freaky Friday is pulling out a celestial trump card that could slow down the theft case she’s currently fighting.

She’s set to ask the judge to cancel this Friday’s hearing because it’s Good Friday, a Christian holiday that marks the crucifixion of Jesus Christ.

Believe or not, Lindsay plans to observe the holy day!

The 24-year-old former Mean Girl was raised Catholic, but reportedly converted to Judaism when she was dating girlfriend Samantha Ronson.

The postponement request was discussed last week during the meeting between Lindsay’s high powered attorney Shawn Holley, Judge Stephanie Sautner and Deputy District Attorney Danette Meyers.

While all involved agreed in principle, it’s not a done deal.

“The DA wants Lindsay’s lawyer to formally file the motion to continue the preliminary hearing,” the source said.

Lohan would still appear in court on Friday but just to hear Sautner formally rule on the motion. If a new date is set, it’s likely to be sometime next month.

Despite rumors that Lohan would plead guilty before trial, we’re told Holley won’t allow it.

If Lindsay is convicted of stealing a $2,500-necklace from a Venice Beach, Calif., jewelry store in February, she could face up to three years in state prison.
