Lohan allowed back on the road

Lindsay Lohan has been handed the keys back to her car. The wayward actress had been claiming that the Betty Ford clinic confiscated her car keys because they felt paps were creating an “unsafe driving situation” for her. But sources say that Betty Ford returned Lindsay’s keys to her on December 7. Not sure if it was Betty herself that gave them back.

Apparently Lindsay impressed them with the way in which she patiently dealt with the delay in getting her keys. And they finally handed them back after phone calls from her parents Dina and Michael.

She’ll still need a pass to leave Betty Ford. But if she can get a hold of that, she’ll be back on the road.

Lindsay ‘beyond upset’ to be named one of 2010′s most ‘provocative’ celebrities

CNN, don’t expect a Christmas gift from Lindsay Lohan this year.

The 24-year-old actress’ holiday spirit has been dampened after HLN’s “Showbiz Tonight” named her one of the most provocative celebrities of 2010 – a title that Lohan reportedly found to be a dishonor.

Sources close to the starlet, who is currently residing in a sober living house, told TMZ.com that she was “beyond upset” to be featured on the list, which was announced Dec. 7.

The show’s producer, Sid Lipsey, said the list was based on “who provoked the most visceral reaction, who provoked the most continuous shock and outrage, who generated the most continued interest throughout the year [and] who had the most lasting impact.”

Keeping Lohan company in the show’s top five picks were other controversial celebrities, like Mel Gibson, Charlie Sheen and Miley Cyrus. The top honor – or, if you agree with Lohan, dishonor – went to Lady Gaga.

“Lohan’s ending the year in rehab,” Lipsey said, “leaving some to speculate (and hope) that this may be the last year we see her on the Most Provocative list.”

It seems Lohan is hoping for that, too – and hoping her celebrity pals will no longer make her the butt of jokes.

The actress’ mom, Dina, told RadarOnline.com that her daughter is “so upset” with supposed friend Gwyneth Paltrow, who made fun of Lohan during a guest appearance last month on “Glee.”

In the Nov. 16 episode, Paltrow played a Spanish teacher who, during a lesson, tells her students that Lohan is “totally crazy,” and asks “How many times has Lindsay Lohan been to rehab?”

“Lindsay was watching it while in Betty Ford,” Dina explained to Radar, “then she called me and was upset and said, ‘Why did she have to do that?’”

After noting that Lohan is more than willing to poke fun at herself, Dina added that “Gwyneth went overboard and it was unnecessary … Lindsay thought she was a friend and it was disappointing.”

But now mother and daughter are looking to the future.

“2011 is going to be different,” Dina said.

Lindsay stuck in L.A. for Christmas; Dina wants her home in NY

Lindsay Lohan will be spending the upcoming Christmas holiday in Southern California, RadarOnline.com has learned exclusively, though it’s still unclear who she’ll be surrounded by.

Her mother Dina “wants Lindsay to go home to Long Island for Christmas, [but] that won’t be happening,” a source with knowledge of the situation told us. “Judge Elden Fox was very clear with his order that he wanted her to stay in rehab until after New Year’s.”

Our source said the 24-year-old Mean Girls star has excelled in her sober living facility, even earning passes to leave the sober house for shopping excursions and visits to her Los Angeles home.

Still, “Lindsay won’t be allowed to leave the state of California for Christmas, period,” according to our source. “It was never a consideration for Thanksgiving and it won’t be for Christmas. Dina wants her home, but Michael is supporting whatever Lindsay’s treatment team is recommending.”

The holidays can be a cause for concern, according to our source, with “all of the angst, forced familial time and dealing with recovery. Mix in parents that don’t get along and Lindsay is going to be tested — and that isn’t a bad thing.”

Lindsay and her treatment team are confident that the actress will be able to get through the holiday season without any setbacks, the source said. While they want Dina and her siblings to come to California for Christmas, lingering tension between family members may throw a roadblock toward such a reunion.

“Dina hasn’t agreed to be anywhere under the same roof with Michael,” the source said. “Lindsay’s counselors recognize that family is very important to Lindsay and they are really hoping to get the entire family under one roof for some much needed family therapy. Michael has agreed to do it. So far, nothing from Dina indicating she is even considering it.”

Lindsay could earn a pass to spend Christmas Eve or Christmas Day out of the sober living facility if she gets the OK from her treatment team, according to our source.

The actress has impressed her doctors and others by focusing her efforts toward helping the less fortunate, our source said, as she “recognizes how blessed she is to be given this amazing opportunity to get and stay sober.”

Lohan’s lawyer: Judge says allegations against Lohan are ‘weak’

The legal woes and court appearances of Lindsay Lohan made worldwide headlines in 2010 and it appears 2011 may be no different for the Mean Girls star.

An April 2011 trial date has been set in a civil lawsuit filed against Lohan in connection with her infamous 2007 DUI arrest but the allegations made against the actress may not make that strong of a case.

At a status hearing in Beverly Hills court Thursday morning, Judge Richard Stone weighed in on the allegations made against Lohan.

In an exclusive interview with RadarOnline.com, Lohan’s powerhouse civil attorney, Ed McPherson says the judge acknowledged that the boys’ allegations were “weak.”

“For instance, they have a claim for ‘battery’ which is what most people would construe as one person punching another person. The judge acknowledged that Lindsay never even touched any of the boys, but that somebody, somewhere, might construe what she did as a “battery,” McPherson says.

And although Lohan appeared for her deposition in May 2010, McPherson also tells RadarOnline.com that the actress still has to be deposed one final time before the trial begins in April 2011.

“She still needs to appear for two hours to answer questions about whether she has any “regrets” about what she did,” McPherson says.

McPherson also tells RadarOnline.com that Lohan will attend the trial, scheduled to begin on April 25, 2011.

Lindsay Lohan wants restraining order against paps

Lindsay Lohan is seeking a restraining order against the paparazzi, in a bid so she can drive and feel safe.

The troubled actress – presently in court ordered rehab at the Betty Ford Center in Los Angeles for drug problems – has asked her lawyers to apply for an order to stop her being followed every time she drives.

Lindsay’s legal problems initially stem from a 2007 arrest for driving under the influence (DUI), and in August she re-applied for her driving licence and was back behind the wheel.

She will have lost driving privileges again when failing court ordered drug tests, but gossip website TMZ reports it was recently agreed by the Los Angeles County probation department and Department of Motor vehicles (DMV) she could get back on the road. Her treatment centre, however, decided it was too much of a safety risk for her to drive, because of the paparazzi attention she attracts, prompting her to seek legal action.

Lindsay reportedly sent pictures of photographers following her to her lawyer, but it is not known if a restraining order is a viable option.

The ‘Machete’ actress has recently been granted the right to leave the Betty Ford Center periodically to spend time at her Hollywood apartment, and was also allowed to spend thanksgiving with her family.

The 24-year-old star was recently said to be looking forward to “feeling free” again after her scheduled discharge from the rehab facility on January 3 next year.

A source said: “She wants to be back in her own space and feel like she’s free again even if she’s knows it’s just temporary until after the beginning of the year.”
